AI Disclosure Policy

1. Purpose of This Policy

This AI Disclosure Policy explains how ConvoPal AI LLC (“ConvoPal AI,” “ConvoPal,” “we,” “us,” or “our”) uses and provides artificial-intelligence and automated technologies.

It also describes the limitations of those technologies and the responsibilities of businesses that purchase, configure, or use our services (“Customers”).

This Policy applies to AI receptionists, voice agents, website chatbots, automated messaging, lead-management tools, appointment-booking tools, customer-relationship-management features, automated workflows, and related services offered by ConvoPal AI collectively referred to as the “AI Services.”

This Policy is incorporated into and forms part of the ConvoPal AI Terms of Service and any applicable order form or service agreement.

2. Third-Party and White-Label Technology

ConvoPal AI provides managed, configured, and white-labeled access to technology supplied by third-party platform and service providers.

The AI Services may be powered or supported by HighLevel and by third-party providers that supply artificial-intelligence models, voice generation, transcription, telecommunications, text messaging, email, hosting, scheduling, integrations, data processing, and other functionality.

ConvoPal AI does not independently develop, own, operate, or control all underlying software, AI models, telecommunications networks, or infrastructure used to provide the AI Services.

Third-party providers may update, change, restrict, replace, suspend, or discontinue features. They may also experience outages, delays, errors, service limitations, or other technical issues outside ConvoPal AI’s reasonable control.

HighLevel and other underlying technology providers are not parties to the agreement between ConvoPal AI and its Customers. Customers must direct all service inquiries and disputes to ConvoPal AI rather than to an underlying platform provider.

3. Disclosure of AI Interactions

The AI Services may communicate with callers, website visitors, leads, customers, employees, and other individuals using artificial-intelligence-generated voice, text, or automated messages.

ConvoPal AI intends for AI agents to identify themselves in a reasonably clear manner when a person could otherwise reasonably believe that the person is communicating with a human.

Customers may not:

  • Falsely represent an AI agent as a human employee;
  • Remove or intentionally circumvent required AI disclosures;
  • Instruct an AI agent to conceal its artificial nature;
  • Use an AI agent to impersonate a real person without that person’s authorization; or
  • Use deceptive names, statements, or configurations intended to mislead people about who or what they are communicating with.

A Customer may customize the exact disclosure language so long as it remains accurate, clear, and compliant with applicable law.

4. AI-Generated Responses May Be Incorrect

Artificial-intelligence systems are probabilistic and may occasionally produce responses or take actions that are:

  • Inaccurate;
  • Incomplete;
  • Outdated;
  • Inconsistent;
  • Misleading;
  • Inappropriate;
  • Delayed;
  • Unavailable; or
  • Unrelated to the question or instruction received.

AI systems may misunderstand a caller or website visitor, fabricate details, incorrectly interpret a request, provide inaccurate information, or perform an unintended automated action.

ConvoPal AI does not guarantee the accuracy, completeness, timeliness, reliability, tone, legality, appropriateness, or suitability of any AI-generated response or automated action.

No AI-generated statement should be treated as independently verified merely because it was delivered through the AI Services.

5. Customer Responsibility for Business Information

Customers are responsible for providing accurate, complete, and current information used to configure the AI Services.

This includes information concerning:

  • Products and services;
  • Pricing and fees;
  • Hours and availability;
  • Appointment policies;
  • Cancellation and refund policies;
  • Locations and service areas;
  • Promotions and offers;
  • Business qualifications;
  • Frequently asked questions;
  • Customer-service procedures;
  • Legal disclosures;
  • Escalation instructions; and
  • Any scripts, prompts, documents, websites, or other information supplied to the AI Services.

ConvoPal AI is not responsible for errors resulting from inaccurate, incomplete, outdated, contradictory, misleading, or unlawful information provided by a Customer.

Customers must promptly notify ConvoPal AI when business information, pricing, policies, availability, or instructions change.

6. Testing, Review, and Human Oversight

Customers are responsible for reviewing and approving the initial setup of their AI Services before public use.

Customers must:

  • Test the AI agent, chatbot, workflow, and relevant integrations;
  • Review sample calls, conversations, messages, and automated actions;
  • Confirm that business information and instructions are accurate;
  • Monitor the AI Services on an ongoing basis;
  • Maintain appropriate human oversight;
  • Establish a method for escalating requests to a qualified person;
  • Correct known errors promptly;
  • Review appointments, leads, messages, and other important actions; and
  • Independently verify material information before relying on it.

Customer approval of a configuration means that the Customer has had a reasonable opportunity to test and review that configuration.

ConvoPal AI does not continuously review every live call, chat, message, appointment, or automated action before it occurs.

7. Live and Unreviewed Communications

Customers acknowledge that AI interactions commonly occur in real time and without prior review by ConvoPal AI or a human representative.

An AI agent may generate and communicate a response immediately based on Customer Content, platform settings, conversation context, and third-party AI functionality.

Customers accept the inherent risks associated with permitting AI to communicate or perform automated actions on their behalf.

Customers remain responsible for their business’s communications, representations, offers, prices, appointments, customer-service decisions, and actions made through their accounts.

8. Appointments and Automated Actions

The AI Services may schedule, reschedule, or cancel appointments; capture or qualify leads; create or update customer records; route conversations; send messages; trigger workflows; or perform other configured actions.

These actions depend on information, instructions, calendars, integrations, system availability, and third-party services.

ConvoPal AI does not guarantee that:

  • Every requested appointment will be booked;
  • Every booking will use the correct calendar or time;
  • Double bookings will never occur;
  • Every workflow will trigger;
  • Every message will be delivered;
  • Every integration will remain connected;
  • Every lead will be properly categorized;
  • Every call will connect; or
  • Every automated action will be completed successfully.

Customers are responsible for reviewing important appointments, transactions, messages, and automated actions before relying upon them.

9. No Authority to Make Binding Commitments

Unless expressly authorized and configured by the Customer, an AI agent is not authorized to:

  • Enter into a binding contract;
  • Modify an existing contract;
  • Guarantee pricing or availability;
  • Approve refunds or credits;
  • Waive fees;
  • Admit legal liability;
  • Make warranties;
  • Settle disputes;
  • Authorize financial transactions; or
  • Make another material commitment on behalf of the Customer or ConvoPal AI.

Customers are responsible for clearly identifying which actions their AI agents may and may not perform.

Any authority granted by a Customer to an AI agent is granted at the Customer’s risk and remains subject to the Customer’s monitoring and verification obligations.

10. No Guaranteed Business Results

ConvoPal AI does not guarantee that use of the AI Services will:

  • Generate a particular number of leads;
  • Produce sales or revenue;
  • Increase profitability;
  • Book a particular number of appointments;
  • Obtain positive reviews;
  • Improve customer retention;
  • Answer every call or message;
  • Prevent every missed opportunity; or
  • Produce any particular business result.

Statements concerning potential benefits, examples, projections, demonstrations, or previous customer outcomes are illustrative and are not guarantees of future performance.

Actual results depend on factors outside ConvoPal AI’s control, including the Customer’s business, reputation, pricing, demand, marketing, lead quality, staff, products, services, configuration, response times, and follow-up practices.

11. No Professional Advice

AI-generated content does not constitute legal, medical, financial, tax, accounting, insurance, employment, or other licensed professional advice.

Customers may not rely on the AI Services as a substitute for an appropriately qualified professional.

Unless ConvoPal AI expressly approves the use in a signed written agreement, Customers may not configure the AI Services to make final or unreviewed decisions concerning:

  • Healthcare diagnosis or treatment;
  • Legal rights or obligations;
  • Insurance coverage or claims;
  • Credit or lending;
  • Employment;
  • Housing;
  • Education admissions;
  • Financial eligibility;
  • Public benefits; or
  • Other decisions that may materially affect a person’s rights, safety, finances, health, or access to essential services.

Appropriate human review must be used for sensitive or consequential decisions.

12. No Emergency Use

The AI Services are not emergency-response systems.

They are not intended to replace 911, law enforcement, fire departments, emergency medical services, crisis services, poison-control services, or other emergency resources.

Customers must not market or configure the AI Services as guaranteed emergency-response tools.

Customers whose businesses may receive urgent or emergency communications must maintain clear escalation procedures and direct individuals to appropriate emergency services.

13. Calls, Texts, Emails, and Consent

Customers are responsible for determining whether they have legally sufficient permission to contact each recipient through calls, artificial or prerecorded voices, AI-generated voices, text messages, emails, or other automated communications.

Customers are responsible for:

  • Obtaining required consent;
  • Maintaining records of consent;
  • Using accurate consent language;
  • Honoring opt-out and do-not-call requests;
  • Following calling-hour restrictions;
  • Maintaining required registrations;
  • Providing legally required disclosures; and
  • Complying with telecommunications, marketing, privacy, and consumer-protection laws.

ConvoPal AI does not independently verify that every person entered into a Customer’s account has consented to every communication.

Availability of a feature does not mean that every use of that feature is lawful.

14. Call Recording, Monitoring, and Transcription

The AI Services may include call recording, monitoring, transcription, summarization, or analysis.

Customers are responsible for determining whether these features may lawfully be used and for providing required notices and obtaining required consent before recording, monitoring, or transcribing a communication.

A notice contained only in this website Policy may not, by itself, provide sufficient notice or consent for a particular call.

Customers must configure audible or other appropriate disclosures for calls when legally required.

ConvoPal AI’s provision or configuration of a recording feature is not legal advice and is not a representation that the Customer’s use complies with every applicable law.

15. Customer Content, Intellectual Property, and Privacy

Customers must have all rights, permissions, licenses, and consents necessary to submit information, recordings, scripts, documents, websites, images, trademarks, customer data, and other content to the AI Services.

Customers may not use the AI Services to:

  • Infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights;
  • Generate defamatory or unlawful statements;
  • Impersonate another person;
  • Create deceptive endorsements or reviews;
  • Process unlawfully obtained data; or
  • use another person’s voice, likeness, identity, or content without appropriate authorization.

Customer Content and personal information may be processed by ConvoPal AI and by applicable platform, AI, telecommunications, hosting, and integration providers as described in the ConvoPal AI Privacy Policy and any applicable Data Processing Addendum.

16. Sensitive and Regulated Information

Unless expressly approved by ConvoPal AI in a signed written agreement, Customers must not submit or instruct the AI Services to collect:

  • Social Security numbers;
  • Full payment-card numbers or security codes;
  • Bank-account login information;
  • Passwords or authentication credentials;
  • Government identification documents;
  • Biometric identifiers;
  • Protected health information;
  • Highly sensitive medical information;
  • Information knowingly collected from children;
  • Precise geolocation information; or
  • Other information requiring heightened legal or security protections.

Customers are responsible for preventing callers and users from submitting sensitive information where the AI Services are not approved or configured to receive it.

17. Third-Party Providers and Service Availability

The operation of the AI Services depends on third-party technology and service providers.

ConvoPal AI is not responsible for errors, delays, interruptions, blocked communications, platform changes, data-access limitations, or service failures caused solely by third-party providers or circumstances outside ConvoPal AI’s reasonable control.

A third-party provider may:

  • Change its technology;
  • Modify model behavior;
  • Update its policies;
  • Restrict a feature;
  • Impose usage limits;
  • Suspend an integration;
  • Change pricing;
  • Experience an outage; or
  • Discontinue a service.

ConvoPal AI may modify, replace, restrict, suspend, or discontinue an affected feature when reasonably necessary because of a third-party change, legal requirement, security risk, technical limitation, or operational need.

18. Service Monitoring and Improvements

ConvoPal AI and applicable service providers may process conversations, prompts, outputs, logs, recordings, transcripts, account information, and technical data as reasonably necessary to:

  • Operate the AI Services;
  • Provide customer support;
  • Troubleshoot errors;
  • Maintain security;
  • Prevent abuse;
  • Measure performance;
  • Improve configurations; and
  • Comply with legal obligations.

The processing and retention of personal information are governed by the ConvoPal AI Privacy Policy, applicable customer agreements, provider terms, and applicable law.

Customers should not assume that information submitted to an AI feature is confidential or protected by professional privilege unless that treatment has been expressly established in a signed written agreement.

19. Customer Responsibility for Final Use

Customers are responsible for deciding whether AI-generated content or automated actions are appropriate for their business.

Customers assume responsibility for their decision to publish, distribute, rely on, or act upon AI-generated content after receiving a reasonable opportunity to review and monitor the AI Services.

Customers must immediately disable or restrict an AI feature and notify ConvoPal AI when they discover that it is creating a material legal, safety, privacy, security, or consumer-harm risk.

20. Disclaimer and Limitation of Liability

The AI Services are provided subject to the disclaimers, exclusions, and limitations of liability contained in the ConvoPal AI Terms of Service and any applicable signed service agreement.

To the maximum extent permitted by law, ConvoPal AI does not warrant that AI-generated content will be accurate, complete, current, error-free, uninterrupted, or appropriate for every use.

Claims concerning AI-generated responses, automated actions, third-party provider failures, missed communications, appointments, lead handling, or use of Customer Content are subject to the liability limitations in the ConvoPal AI Terms of Service.

Nothing in this Policy excludes responsibility that cannot legally be excluded or limited.

If this Policy conflicts with a signed Master Services Agreement, order form, Data Processing Addendum, or the ConvoPal AI Terms of Service, the applicable signed agreement or Terms of Service will control.

21. Changes to This Policy

ConvoPal AI may update this Policy to reflect changes in:

  • AI functionality;
  • Platform providers;
  • Service features;
  • Business practices;
  • Security practices; or
  • Legal and regulatory requirements.

Material changes will apply prospectively. The revised Policy will be posted with an updated effective date, and additional notice will be provided when required by law or contract.
